Terms and Conditions

These terms apply when you use WispFile at wispfile.com, whether to send files, receive them, or use an account or paid plan. WispFile is developed by Mohiemen (mohiemen.com). By using it you agree to these terms. If you do not agree, please do not use WispFile.

1. What WispFile does

WispFile connects two browsers so that files can travel directly from the sender’s device to the receiver’s. Files are encrypted in the sender’s browser with a key that is part of the link and never sent to our servers. We do not store files. On paid plans, if two networks cannot connect directly, encrypted data may pass through our relay server, which forwards it without storing it and cannot read it.

WispFile is a new service. Features may change, and some browsers and very large transfers are still being tested. Because files come from the sender’s device, a transfer only works while the sender keeps WispFile open.

2. Using WispFile

You may use WispFile without an account. You agree not to use it to:

  • send anything you do not have the right to share, including material that infringes copyright or other rights;
  • send malware, or files intended to damage, deceive or gain unauthorised access;
  • share child sexual abuse material or any other illegal content;
  • harass, threaten or defraud anyone;
  • overload, attack, probe or work around the limits of the service, including the relay;
  • resell or relay WispFile as your own service without our written permission.

Anyone can report a link from its page. We can revoke a link, which disconnects everyone using it and stops it working, and we can suspend accounts that break these terms. Because files are encrypted and never stored, we cannot inspect their contents; we act on reports and on the information we do hold.

3. Your files and your links

You keep all rights to the files you send. You are responsible for what you send and for who you give the link to. Anyone who has the whole link can download while you are sharing; a password, a one-download limit and Stop sharing are there to help you control that. We cannot recover a lost link or key, because we never have it.

4. Accounts

An account is optional. You sign in with an emailed link or with Google. Keep access to your email secure, as it controls your account. Team owners are responsible for who they add to their team and the roles they give them.

5. Paid plans

Pro and Team plans are billed in advance by subscription through Stripe, at the prices on the pricing page when you subscribe. Subscriptions renew automatically until cancelled. You can cancel at any time from Manage billing on your account page; the plan stays active until the end of the period you have paid for. Relay allowances are monthly and do not carry over. If we change a price, we will tell subscribers before it applies to them. If something has gone wrong with a payment, email us at [email protected].

6. Availability and changes

We work to keep WispFile available and reliable, but we do not guarantee that it will be uninterrupted or error-free, or that every pair of networks can connect. We may change, add or remove features. We may update these terms; when we do, we change the date at the top, and for significant changes we will tell account holders by email.

7. Disclaimers and liability

WispFile is provided “as is”. To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement. Keep your own copies of anything important: a transfer is not a backup.

To the fullest extent the law allows, we are not liable for indirect or consequential loss, or for loss of data, profits or business, arising from your use of WispFile. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or US$50 if you have not paid us. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer where you live.

8. Ending use

You can stop using WispFile at any time, and ask us to delete your account by email. We may suspend or end access for anyone who breaks these terms or puts others at risk.
